Plastic Waste Management (Amendment) Rules, 2024: The Ministry of Environment introduced new changes to Plastic Waste Management (Amendment) Rules, 2024. After the amendment, it is making manufacturers of disposable plastic products label their products as ‘biodegradable.’, after new rules the manufacture of products needs to require that biodegradable plastics not only degrade through biological processes in specific environments but also leave no microplastics behind.

The Ministry of Environment, Forest and Climate Change of India has recently introduced amendments to the Plastic Waste Management (Amendment) Rules, 2024 to curb plastic pollution and to reintroduce changes from time to time to regulate plastic manufacturing

1. Expanded Definitions:

• Producer: Includes entities manufacturing plastic packaging and intermediate materials for it.
• Manufacturer: Now encompasses the production of compostable and biodegradable plastics.
• Importer: Covers various plastic resins and materials for commercial use.

1. Responsibility of Local Bodies:

• Local bodies assess and manage plastic waste, preventing the usage of prohibited items. where they need to take necessary measures to prevent the stocking, distribution, sale and usage of prohibited single-use plastic items in their jurisdiction.

1. Selling of Plastic Raw Materials:

• Restrictions on selling plastic raw materials for prohibited items manufacturing.

1. Registration and Reporting Obligations:

• Manufacturers and importers are required to register and submit reports to State Pollution Control Boards.

1. Introduction of Sellers:

• Definition and reporting requirements for entities selling plastic raw materials.

1. Introduction of New Biodegradable Plastics Category:

• Specific labelling requirements for biodegradable plastics.

1. Thickness Requirement Exemption for Compostable/Biodegradable Carry Bags:

• Exemption for thickness requirement for compostable/biodegradable carry bags.

• Definition of microplastics and its dimensions.

1. Pre-consumer Waste Processing Obligations:

• Obligations for processing pre-consumer plastic waste at the manufacturing stage.

1. Minimum Recycling Target Introduction:
   • Introduction of minimum recycling targets for plastic packaging waste.
2. Micro and Small Enterprise Exemption from EPR Obligations:
   • Exemption for micro and small enterprises from direct EPR obligations.
3. Target for the Use of Recycled Plastic Content:
   • Mandatory use of the recycled plastic content target.
4. Price Cap Implementation:
   • Establishment of price caps for EPR certificates by CPCB.
5. Annual Filing Deadline Extension:
   • The deadline for filing annual returns for the financial year 2022-2023 is extended until March 31st, 2024.

• The Plastic Waste Management (Amendment) Rules, 2024, now define biodegradable plastics as materials that degrade through biological processes in environments like soil or landfills, with the crucial addition that they leave no microplastics behind.
• However, the rules lack specifications regarding the specific chemical tests permissible for establishing the absence of microplastics.
• Moreover, there is no clear indication of the threshold to which microplastics must be reduced in a sample to be considered eliminated under these regulations.
